TAXI SERVICES COMMISSION ONLINE PRICE NOTIFICATION SYSTEM TERMS AND CONDITIONS

The Price Notification System allows operators and network service providers in Regional and Country Zones to notify hirers of maximum fares or hiring rates to be charged in respect of taxi-cabs. The Price Notification System can be accessed by clicking on the relevant link at www.taxi.vic.gov.au.

Definitions

Application means the online Price Notification System.

Contact Person means the person who registers for a Price Notification System account on behalf of an operator or network service provider.

Country Zone has the meaning given to it in section 86 of the Transport Act.

Network Service Provider (NSP) means a person (including a body corporate, unincorporated body or association and a partnership) who is accredited to provide a taxi cab network service under Part VI, Division 4 of the Transport Act.

Notification means the maximum fares or hiring rates and other fare related information you submit through the Application.

Operator means a person (including a body corporate, unincorporated body or association and a partnership) who is accredited to operate a taxi cab under Part VI, Division 4 of the Transport Act.

Price Notification System (PNS) is the Taxi Services Commission’s online Price Notification System that allows operators and NSPs in Regional and Country Zones to notify hirers of maximum fares or hiring rates to be charged in respect of the taxi-cab.

Regional Zone has the meaning given to it in section 86 of the Transport Act.

Registration Information means the information required to register an account (for example, name of operator or NSP, accreditation number and contact information).

Taxi Services Commission (TSC) means the body corporate established under the section 115B of the Transport Integration Act 2010 (Vic) whose primary object is the regulate the commercial passenger vehicle industry.

Terms and Conditions means these Terms and Conditions that govern the use of the PNS.

Transport Act means the Transport (Compliance & Miscellaneous) Act 1983 (Vic).

Us means the TSC.

You means the operator or NSP.

Terms and Conditions

1. Acceptance of Terms and Conditions

1.1 The use of the Application is subject to these Terms and Conditions. The Terms and Conditions constitute the entire agreement between you and the TSC in respect of your use of the Application.

1.2 Before you register to use the Application (see paragraph 2), you must read, understand and agree to the Terms and Conditions.

1.3 We may amend the Terms and Conditions at any time. The amended Terms and Conditions will be the terms upon which you use the Application.  The most recent Terms and Conditions will be available to view on the Application.

1.4 Your continued use of the Application following any change will constitute your acceptance of any updated Terms and Conditions.

2 Registration Information

2.1 In order to use the Application you will need to register an account.

2.2 To register an account you must provide the required Registration Information, namely:

  • the type of accreditation;
  • the name of the accredited operator or NSP;
  • the accreditation number;
  • the trading name (if different from the name of the accredited entity);
  • the address and phone number of the operator or the NSP;
  • the primary passenger booking phone number;
  • the full name and email address of the Contact Person; and
  • the password.

2.3 You agree to:

  • only register one account for the operator or the NSP; and
  • submit accurate Registration Information and keep it up-to-date.

2.4 Registration Information is subject to the TSC’s Privacy Policy which can be found at http://www.taxi.vic.gov.au/about-us/privacy-policies.

3 User Account, Password and Security

3.1 After you register, the TSC will review the Registration Information and send you confirmation that your user account is active.

3.2 You agree that:

  • you are responsible for maintaining the confidentiality of your password;
  • you are fully responsible for all activities that occur under your password and username;
  • you must immediately notify the TSC of any unauthorised use of your password or username or any other breach of security;
  • we, or our agents, may require access to your account to respond to service or technical issues; and
  • we may send emails and other information to your user account.

4 User Conduct

4.1 You are prohibited from submitting Notifications which:

  • use language or express ideas that are harmful, threatening, abusive, harassing, defamatory, discriminatory or obscene;
  • are illegal;
  • make any false claim that you are authorised to act on behalf of an operator or NSP; and
  • contain software viruses, trojan horses, worms, time bombs, cancelbots or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

4.2 You must not:

  • interfere with another user's use of the Application;
  • make any unauthorised commercial use of the Application;
  • circumvent, disable or interfere with security related features of the Application; or
  • circumvent, disable or interfere with any features that prevent or restrict the copying of any Registration Information or Notifications from the Application or imposing limitations on the use of the Application.

5 General Practices Regarding Use and Storage

5.1 You acknowledge and agree that the TSC:

  • can manually enter Notifications onto the Application on your behalf (for example, if no internet connection is available);
  • may capture fares  into a database or spread sheet for a minimum of seven years;
  • may archive and search all data and generate regular reports from the Application;
  • must disclose information to the Essential Services Commission in accordance with the TSC’s legislative obligations; and
  • may disclose Registration Information or Notifications if required to do so by law or in the good faith belief that preservation or disclosure is reasonably necessary to:
    • comply with an obligation;
    • enforce these Terms and Conditions;
    • respond to claims that a Notification violates the rights of third parties; or
    • protect the rights, property, personal safety, or business interests of the TSC, users of the Application or the public.

5.2 The TSC may make modifications to the Application or temporarily discontinue access to the Application (or any part), with or without notice, without liability to you or to any third party.

5.3 The TSC does not guarantee that the Application will be uninterrupted, timely, secure, or error-free.

6 Responsibility for Registration Information and Notifications

6.1 You are responsible for the accuracy of the Registration Information and Notifications that you submit and that are published on the Application.

6.2 The TSC may reject a Notification that you submit if it does not comply with these Terms and Conditions.

6.3 With your prior approval, the TSC may edit a Notification that you submit.

6.4 You agree that if you do not notify any maximum fares or hiring rates through the Application, the fares and rates determined by the Minister for Transport will be published as the default rate.

6.5 You agree that the TSC or any of its employees or agents are not responsible for:

  • any person's reliance on the Registration Information and Notifications published on the Application; or
  • any loss in connection with the use of the Application.

6.6 You agree that the TSC is not liable in the unlikely event that you suffer any loss or expense arising from:

  • the use of, or the inability to use the Application;
  • transactions entered into as a result of the Application;
  • unauthorised access to or alteration of your Registration Information or Notifications;
  • statements or conduct of any third party on the Application; or
  • any other matter relating to the Application.

6.7 You agree to indemnify the TSC against any loss, expense or liability reasonably incurred by the TSC in relation to the Application, where that loss, expense or liability results from your wilful misconduct or negligence.
