Licence conditions - restricted hire vehicle tour licences

Sections of the Commercial Passenger Vehicle Industry Act 2017 relating to commercial passenger vehicle licences are now law. Information about the changes is available on the Industry reforms page.

Transport (Compliance and Miscellaneous) Act 1983

(a) The licensed vehicle must only provide transport in combination with a tour package.

  1. A "tour package" means a combination of services provided for a price comprising the hiring of a commercial passenger vehicle and as a substantial component of the package, accommodation or other services or facilities appropriate to tourists.

  2. (b) The tour package must be pre-booked with a travel agency or the company or the person offering tours, including travel and accommodation, or travel and some other "tourist service" and include all services at an inclusive price agreed with the hirer prior to commencement of a tour.
  3. (c) Evidence of the pre-booked tour being undertaken at the time must be retained in the vehicle and made available for inspection upon request by authorised officers of the Taxi Services Commission.
  4. (d) The licence holder must have a public liability insurance policy in force at the time of providing a tour package.
  5. (e) The licensed vehicle is prohibited from providing corporate, commuter or airport shuttle services.
  6. (f) The licence is non-transferable.
  7. (g) The vehicle must be registered in the name of the licence holder.
  8. (h) The licensed vehicle must have a seating capacity for at least 8 but not more than 9 people (including the driver) but must not be a vehicle which has been structurally modified to increase its seating capacity beyond that intended by the original manufacturer.
  9. (i) A certificate of roadworthiness must be obtained in respect of the licensed vehicle and supplied to the Taxi Services Commission annually.
  10. (j) The licensed vehicle must be managed and operated from a premises approved by the Taxi Services Commission.
  11. (k) Accurate records must be maintained of the operation of the licensed vehicle. The records must be kept at the premises specified in this licence and must contain the name of the hirer and booking agent (if applicable), date of tour, price charged for the tour and disbursement of charges for other services, registration of the vehicle(s) used for the tour and the name, address and driver certificate number of the vehicle driver(s). These records must be made available for inspection as required by the Taxi Services Commission.
  12. (l) A copy of the licence conditions must be carried in the licensed vehicle at all times and that the licence conditions must be produced on demand to an officer of the Taxi Services Commission.
  13. (m) The licensed vehicle must display any label or special registration plates required by the Taxi Services Commission to identify the vehicle as a licensed restricted hire tour vehicle.

A licensed vehicle when operating as a commercial passenger vehicle must at all times be driven by a person who holds a current Drivers' Accreditation. To obtain a Drivers' Accreditation a driver must apply to the Taxi Services Commission or any VicRoads Registration and Licensing Office.

Special Identifying Numbers (Custom Plates), Black & White Reflective Identifying Numbers and Personalised Plates where an "Agreement" between VicRoads and the purchaser is signed, cannot be issued to any vehicle which is licensed or becomes licensed as a commercial passenger vehicle under the Transport (Compliance and Miscellaneous) Act 1983. The only exemption from the above is where the "Agreement" was signed prior to 1 January 1994.

In the future the TSC will require special identifying number plates to be displayed on commercial passenger vehicles.
