Licence conditions - restricted hire tricycle licences

Sections of the Commercial Passenger Vehicle Industry Act 2017 relating to commercial passenger vehicle licences are now law. Information about the changes is available on the Industry reforms page.

Transport (Compliance and Miscellaneous) Act 1983

  1. 1 The licence is non- transferable and non- assignable.
  2. 2 The vehicle must be registered in the name of the licence holder.
  3. 3 The licensed vehicle must:
    1. i. carry passengers to its constructed seating capacity.
    2. ii. be managed and operated by the licence holder from XXXXX, or from other premises approved by the Taxi Services Commission (TSC).
    3. iii. operate for the carriage of passengers on a pre-booked basis through the approved premises.
  4. 4.1 The licensed vehicle may also operate for the carriage of passengers:
    1. (a) from any place for the purpose of a tour or pleasure ride when the hiring is engaged from a temporary booking facility or by promotion of services on a signboard displayed at that place; and subject to information displayed on any signboard being limited to:
      • licence holder's name, trading/business name and contact details
      • services which are authorised by licence conditions, and
      • hiring rates for services.
    2. (b) as a transfer service between two points when the hiring is engaged from a site at a major event , and provided that such site has been approved by the TSC.
    For the purpose of these conditions, a tour or pleasure ride means a journey that commences and finishes at the same location.
  5. 4.2 The licence holder at all times remains responsible for obtaining any approval required by the coordinator of any fete, fair or similar event and/or the relevant municipal council, for the operation of any service and for the use of any stand or sign, as authorised under clauses 4.1 (a) and 4.1 (b).
  6. 4.3 Hiring rates must be by agreement with the hirer made prior to the commencement of the hiring.
  7. 4.4 The operator must maintain accurate records of the operation of the licensed vehicle including details of each hiring. These records must be made available for inspection as required by an officer of the TSC or a member of the Victorian Police.
  8. 4.5 A copy of the licence conditions must be carried in the licensed vehicle at all times and must be produced on demand to an officer of the TSC or the Victorian Police.
  9. 4.6 If an incorporated body holds the licence, the company concerned must notify the TSC within seven (7) days of any changes to the persons constituting the directors of that company.
  10. 4.7 Prior to the commencement of any hiring, all passengers must be supplied with a clean, hygienic motorcycle helmet that complies with all parts of Rule 270 of Road Rules Victoria.
  11. 4.8 A Certificate of Roadworthiness must be supplied annually from the date of licence issue or more frequently as required by the TSC.
